The supporters of this judgment are claiming that it’s going to reduce the chances of AIDS.The fear of punishment prevented the gays from stating their woes publicly or ,for that matter, to the doctors.What you have to say in this regard ?

It hardly matters that whether it is going to reduce chances of AIDS or not. The only question is of freedom and personal choice. This judgment is historical from the point of personal freedom.

We have to also keep in mind what precedents are set by such ”freedom and personal choice”.We cannot justify our love for dubious activities in name of honouring freedom and personal choice.

Such judgments are going to topple the very tenets of an ideal society by encouraging love for things not in tune with natural order of living.

Mr Avdhut just tell me what happens if in name of honuoring freedom and personal choice one has consensual sex with a minor? Will the law justify this act in name of freedom and personal choice ?

In my eyes, one should always be conscious of results of his/her personal choices.

Hi Arvind,

Chances of AIDS is not going to be reduced by this legisltaion but by use of CONDOMS.Why not legalise prostitution because Sexually transmitted disceases are caused by it?By the way how many AIDS sufferers who are not gay are going to doctors voluntarily? NIL

Legalize the prostitution? That is the point related with this judgment. The opponents of this judgment have already stated that people will demand to legalize many wrong things and you are proving them right.

It will reduce it because you cannot give an education class on how to do something that is illegal. By getting rid of the law, they are now free to educate people about the particular hazards that homosexuals face.

When you remove the hurdles in way of wild behaviour then be sure you are creating room for new set of problems.That’s the risk involved in decrimininalisation.You are not only giving rise to new set of complexities but also giving rise to people having an inclination towards lesser heard behaviour who,due to fear of law, would otherwise have kept their desires in check.

Section 377 talks about the order of the nature but how could we decide the right and wrong according to nature. BTW, homosexuality is not against the nature and people have been practicing this from ancient times. So we need to amend the constitution itself.

Hi Milind,

There arre plenty of activity prohibited by law and society which we do as we are humans.Like ADULTERY for instance between consenting adults.So far nobody in India is convicted for ”adultery” or for ”consenting homosexual activity”. Like the 15,000 Catholic preists in USA who seduced and sodomised boys in USA.No catholic preist is either convicted or defrocked.

There are men who have relations with sheep, it is his personal choice and the goat cannot complain.But then as long it is criminal he has to do it in FOUR CORNERS OF WALLS.So also Homosexual activity, if both are consenting adults, have it within four corners of walls.

do not ask for social sanction.Even if some two judges or ten of supremcourt permit it, Islam,Christianity,Akhal Takht,Hindu preists donot permit it.

So that answers the ”why SUDDENLY?” question.

They should only change it so that it is to be in-line with the Constitution.

As per Article 13(2) The State shall not make any law which takes away or abridges the rights conferred by this Part (Fundamental Rights) and any law made in contravention of this clause shall, to the extent of the contravention, be void.

Chief Justice A P Shah and Justice S Murlidhar found IPC 377 violative of Articles 14, 21 and 15 of the Constitution.

I agree with them 100% because thats equality before law. The State shall not discriminate against any citizen on grounds only of religion, race, caste, sex, place of birth or any of them.

None of the 4 vedas or Bhagavat Gita mentioned anything against homosexuality. But Bhagavat gita in 5.22 says

”yehi samsparsa-ja bhoga duhkha-yonaya eva te

ady-antavantah kaunteya na tesu ramate budhah”

means pleasures arising from contact of sensory organs are source of misery and pain and those who are spiritually intelligent will not indulge in that. This is applicable to everyone no matter what their sexual orientation is.

Your definition of gay/lesbian is totally absurd

If you can enjoy sex with same sex atleast in your fantasies then you are homosexual or bisexual. Hetrosexuals are not superior to any other sexual orientations and vice versa. Whoever cant accept the creation of God are insulting HIM and are homophobic.

Homophobia is a fear of, aversion to, or discrimination against homosexual people. It manifests in different forms, and a number of different types have been postulated, among which are internalized homophobia, social homophobia, emotional homophobia, rationalized homophobia, and others. Similar is lesbophobia (specifically targeting lesbians) and biphobia (against bisexual people). These people need to get immediate medical help before they commit some hate-crime.

If Sex is for procreation and anything else is perversion then does Captain suggest everyone to do intercourse only one or two times in their life time?

I would also like to point out that a study done in 2006 says the 46% of men who have sex with men in India are also married. It was illegal then but still almost half were doing it and probably spreading HIV/AIDS to their wives and their wives were spreading it to their babies. The guy in this story likely will or has already done so.

I said ”Sex is for Procreation”.You can procreat only by having sex with opposite sex only.Pleasure is a bonus but it is not the purpose.

Just imagine a world where everyone is Homo sexual.What happens to human race?

Personal freedom, Personal choice.

My personal choice is to sodmise young children.Can the state allow it?

If one person wants to have sex with his own daughter and he gets consent from her.Does the state or society have no role to play?Ofcourse it is the personal choice of both adults.

I didnt say its Personal freedom, Personal choice but its thier nature and they are creation of nature. They are genetically different, its their hormons make them do so. They will have the same feeling, when asked to do sex with opposite sex, that you will have when you are asked to do with same sex.

There is no question about incest or perversion here, you got it totally wrong. You better read yourself how many are doing sex with blood relation here

Do you know why incest is a crime? Think about it... for hundreds of years royal families committed incest just so they would never have to share power outside the family.

What happened to those families? Hemophilia, insanity, retardation, miscarriages and physical deformities. Until the point where there was no one left to carry on the line. They had to start making alliances marrying from other families.

Infinite diversity in infinite combinations is the only thing that keeps genetic lines strong, whether it is crops, livestock or humans.

Look at the Irish potato famine, there was no diversity... none in their diets, none in the variety of potato and none in the type of livelihood. So when the blight struck, it moved quickly because the crops all had the same degree of resistance. There was nothing else to turn to eat because it was the only crop and the only source of income. A million people starved and another million migrated.

Now just think if all the people in the world through out history had all been heterosexual and all bent on reproducing as soon and as often as they could as per the orders of religion?

Diversity is a good thing.

After AIDS was discovered, there was a movement to educate people about it. The cases of AIDS and HIV rose slower than before the education.

In 1996,The Religious party began a campaign for all sex education be stopped and replaced with abstinence only programs . They demanded that no federal tax money be used for sex education. They got their way and The cases of AIDS/HIV began to rise as well as the cases of teen pregnancy which had declined every year for 12 straight years prior to the religious classes on abstinence.

The abstinence only classes teach that condoms have a high failure rate and are not to be trusted. Any attempt to provide condoms to high risk groups was also stopped.

Here is the kicker... The US government had been funding sex education in Africa too but they replaced it with the abstinence only curriculum as well. They also stopped funding any family planning. The results of all that have been devastating.

Thanks to George Bush, 15 billion dollars has been spent to spread misinformation!!!!! Not that that should come as a surprise to anyone.

dont worry about 15 billion... Dollar is worth no more than paper. All the US govt does is to make a request to Federal Reserve and Fed will agree to buy treasury bonds (printed fancy papers with no corresponding material value) from govt worth the money requested for and thats it; that much money is created!!! Dollar has no material value.
